Terms of Sale and License
Operador Listo · operadorlisto.com Last updated: October 27, 2026
This is an English translation of our Spanish-language terms, provided for convenience. If the two versions differ, the Spanish version prevails.
These terms govern the purchase of Operador Listo products, the monthly program subscription, and the license to use them. Please read them before you pay: by confirming your payment, you accept them.
1. Who we are
Tesla Market Insight, S.A. de C.V. (“Tesla Market Insight,” “we,” or “us”), located at Arquímedes 205, Polanco, Alcaldía Miguel Hidalgo, C.P. 11560, Mexico City, Mexico, operates the Operador Listo brand and the operadorlisto.com website.

2. How your purchase is made
- Your purchase is made electronically, under Articles 1803 (section I), 1811, and 1834 bis of Mexico’s Federal Civil Code and Article 80 of Mexico’s Commercial Code. You accept these terms when you confirm your payment.
- Before you pay, the checkout page shows the product, the number of drivers, the total price, the currency, and, for the subscription, how often you will be charged, so you can review your order.
- Each purchase is governed by the version of these terms in effect on the date you made it. We recommend keeping a copy.
- If you buy on behalf of a company, you confirm that you are authorized to bind it. In that case, “you” means the company.
3. What you are buying
Each product page on the site describes the product, its contents, and its price. We offer:
- “Programa Inglés para la revisión” (Roadside English Program), monthly subscription. Training so drivers can answer in English during a roadside inspection: a web-based practice simulator, audio lessons, a driver workbook, and an Excel compliance record. It is priced per driver per month, with a minimum of 10 and a maximum of 500 drivers; you choose the number at checkout. The subscription renews every month until you cancel it (section 5).
- “Evaluación de flotilla” (Fleet Assessment), one-time payment. This is a self-service product: it includes access to the simulator for 30 calendar days for up to 30 drivers. Your company shares the link with its drivers, each driver takes the “Simulacro calificado” (scored mock test) on their phone, and the company records the results in the Excel compliance record, which calculates the fleet summary. It does not include sessions with our staff or results or reports prepared by us.
- “Operador individual” (Single Driver), one-time payment. Access to the program for 90 calendar days for one driver.
- “Expediente DOT del operador” (Driver DOT File) kit, one-time payment. Downloadable files only: a guide in PDF and Word, an Excel tracking file, and six bilingual Word forms.
To use the products, you need an up-to-date web browser (Chrome, Edge, Safari, or Firefox), a PDF reader, software that opens Word and Excel files, and, for the lessons, an audio player.
4. License
Ownership. The text, audio, exercises, question banks, illustrations, templates, and simulator software are protected by Mexico’s Federal Copyright Law and belong to Tesla Market Insight or its licensors. When you buy, you do not acquire ownership of these materials; you receive a license to use them.
Single-company license. We grant you a non-exclusive, non-transferable license for the purchasing company to use the materials internally, at all of its locations, to train and evaluate its own drivers, whether employees or contractors who drive for it, and to keep its own records. The term and scope depend on the product:
- Roadside English Program: while the subscription is active, for the number of drivers purchased.
- Fleet Assessment: for 30 calendar days from purchase, for up to 30 drivers.
- Single Driver: for 90 calendar days from purchase, for one driver only.
- Driver DOT File kit: the license for the files does not expire.
When the access period or the subscription ends, online access ends. Your company keeps its own records entered in the Excel compliance record and in the kit’s forms.
You may:
- Share the access link with your own drivers, up to the number purchased.
- Save the files on the computers, servers, and phones of the company and its drivers, and print the workbook.
- Fill out and adapt the templates, forms, and Excel files for internal use.
You may not:
- Sell, resell, sublicense, rent, lend, or assign the materials or your access link.
- Share the link with more drivers than you purchased or with other companies, including companies in your corporate group, which must buy their own license.
- Use the materials to provide training or evaluations to third parties for a fee.
- Post them online or in publicly accessible shared folders.
- Remove copyright notices or present the materials as your own.
- Copy the question banks or use the materials to create products that compete with ours or to train artificial intelligence systems.
If you breach these conditions, the license will end without the need for a court order, and we may take any action available to us under the law.
5. Prices, taxes, payment, and subscription
Prices. On the English version of the site, prices are shown in U.S. dollars (USD), and the USD amount is the total you will be charged. On the Spanish version of the site, prices are shown in Mexican pesos (MXN) plus 16% value-added tax (IVA), with the total including IVA displayed next to them; Stripe charges the total including IVA. Your bank may charge foreign-transaction fees, which we do not control.
Payment. Payments are processed by Stripe, using the payment methods shown on the checkout page. We do not receive or store your full card details.
One-time products. The Fleet Assessment, Single Driver access, and the Driver DOT File kit are paid for in a single payment and do not lead to any later charges.
Monthly subscription to the Roadside English Program. By subscribing, you give your express consent to automatic recurring charges, under Article 76 Bis, section VIII, of Mexico’s Federal Consumer Protection Law:
- Amount: the monthly price per driver multiplied by the number of drivers purchased (plus IVA on the Spanish version of the site). The checkout page shows the total of each monthly charge.
- Billing frequency and date: Stripe makes the first charge when you subscribe and then one charge every month on the same date as your first payment. If a month does not have that date, the charge is made on the last day of that month.
- Renewal: the subscription renews automatically every month until you cancel it.
- Advance notice: Stripe will email the address on file 7 calendar days before each renewal, with the date and amount of the next charge.
- Changing the number of drivers: you may increase or decrease it, between 10 and 500 drivers. Stripe calculates a proportional adjustment for the days remaining in the current period and reflects it in your next charges.
- Cancellation: you may cancel at any time, with no penalty, from Stripe’s customer portal, whose link appears on your access page, or by contacting us on WhatsApp. Cancellation takes effect at the end of the period you have already paid for: you will not be charged again, and you keep access until that date.
Fleet Assessment credit. If your company subscribes to the Roadside English Program within 30 calendar days after buying the Fleet Assessment, the amount you paid for the evaluation will be credited against your first monthly payments. To apply it, request it on WhatsApp within that period.
Promotions. Promotions state their conditions and dates on the site.
6. Delivery
Once your payment is confirmed, we will show you a private access or download link on the confirmation page. In addition, Stripe will email your receipt and access link, on behalf of Tesla Market Insight, to the address you entered at checkout. Delivery is usually immediate. If you have not received the email within 24 hours, check your spam folder and, if it is not there, contact us.
The link is for the exclusive use of your company and its drivers, up to the number purchased; do not share it outside the company. If the link stops working while your access is active or, for the kit, within 12 months after your purchase, we will send you a new one at no cost. We recommend downloading and saving the kit’s files.
7. Invoicing
- If you need a CFDI (Mexican electronic invoice), request it by email or WhatsApp within the calendar month in which the charge was made. For the subscription, you may request a CFDI for each monthly charge. Include the email address you used to buy and your tax details: name or company name, RFC, ZIP code of your tax address, tax regime, and intended use of the CFDI.
- If you do not request it within that time, the sale will be included in the global invoice we issue for sales to the general public, under the rules of Mexico’s Tax Administration Service (SAT), and we may no longer be able to issue you an individual CFDI.
- If you live outside Mexico, we can issue the CFDI using the generic tax ID that the SAT sets for foreign residents.
8. Cancellations, refunds, and guarantee
Right to cancel. Under Article 56 of Mexico’s Federal Consumer Protection Law, you may cancel your purchase, without giving a reason and at no cost, within five business days after we deliver your link. For the subscription, this right applies to the first payment: if you cancel within that period, the subscription ends and we refund that first charge. To cancel, contact us by email or WhatsApp and tell us the email address you used to buy. We will refund the price you paid, to the same payment method, within five business days of your request; your bank may take a few more days to show it. When you cancel, your license ends and you must delete the downloaded files and stop using them.
Later monthly charges. After that period, you may cancel the subscription at any time, effective at the end of the paid period, as described in section 5. Monthly charges already made are not refundable, except in the cases described in the next paragraph.
Defective files or access that does not work. If a file does not work or does not match the product description, or if online access does not work for reasons attributable to us, contact us. You will be entitled, at your choice, to have us fix the problem or to receive a refund for the affected period or product, plus any credit due under Articles 92, 92 Bis, and 92 Ter of Mexico’s Federal Consumer Protection Law.
Unrecognized charges. If you do not recognize a charge, please contact us before contacting your bank, and we will look into it right away.
9. What our products are not
- We are not affiliated with the Federal Motor Carrier Safety Administration (FMCSA), the U.S. Department of Transportation (DOT), the Commercial Vehicle Safety Alliance (CVSA), or any Mexican or U.S. authority, and none of them has approved our products.
- We do not guarantee that a driver will pass a roadside inspection or the English language proficiency assessment. That decision always belongs to the official conducting the inspection, and the criteria may change.
- Simulator results, including the “Simulacro calificado” and the fleet summary, are a training reference, not an official certification.
- The Driver DOT File kit is an organizational tool. It does not replace reading the U.S. Federal Motor Carrier Safety Regulations (49 CFR Part 391) and does not guarantee compliance with them, which is each company’s responsibility.
- Our materials are not legal advice. Regulations change, so always check the current version from official sources.
10. Liability
We commit to providing access and delivering the files as described on the site. How your company uses the materials, and the decisions it makes based on them, including decisions about its drivers, are your company’s responsibility.
To the extent permitted by law, our total liability to you for any claim related to a purchase will not exceed the price you paid for it or, for the subscription, the amount paid in the three months before the claim, and we will not be liable for indirect damages, such as lost profits or lost contracts. This limitation does not apply in cases of fraud or bad faith, and it does not limit any non-waivable rights you have under Mexico’s Federal Consumer Protection Law when you act as a consumer.
11. Personal data
We process your personal data as described in our privacy notice, posted at operadorlisto.com.
12. Changes to these terms
We may update these terms for future purchases. Changes do not affect purchases already made, which remain governed by the version in effect on their date. If a change affects the conditions of an active subscription, we will notify you by email before your next charge, and you may cancel with no penalty before the change takes effect.
13. Complaints
If you have a complaint, contact us at the email address or WhatsApp number in section 1. We will respond within three business days. If you are a consumer, you may also contact Mexico’s Federal Consumer Protection Agency (PROFECO): https://www.gob.mx/profeco
14. Governing law and jurisdiction
These terms are governed by the federal laws of the United Mexican States. For any dispute, the parties submit to the competent courts of Mexico City and waive any other jurisdiction that might apply because of their present or future domicile, without prejudice to consumers’ right to go to PROFECO.
15. Language
These terms are also available in Spanish. If the two versions differ, the Spanish version prevails.
